All slip fees and deposits are non-refundable.
Operator understands that because the Marina is a unique location, that re-licensing of the slip may be difficult for the Marina, that Marina will have hired seasonal staffing based on anticipated Marina occupancy, and that the Marina will suffer damages which may be difficult to calculate because of Operator’s cancellation. Therefore, if Operator cancels their trip before the starting date of reservation, Operator forfeits all deposits and Slip Fees as liquidated damages to compensate the Marina for expenses and losses which result from cancellation of this agreement.
Operator agrees that Marina, at its sole discretion, can apply a credit, for the equivalent amount no greater than 90% of forfeited deposits and Slip Fees, against Operator’s deposits and Slip Fees for reservations in the same boating season.
Operator agrees that if this agreement is not cancelled before the starting date of reservation and the vessel does not arrive at the start date of the reservation, Operator will be charged for the full transient dockage charge under this agreement.
Operator cancelling this agreement due to weather will be entitled to a Marina credit for the equivalent amount no great than 90% of forfeited deposits if there is a NOAA Small Craft advisory warning or higher for the New York Harbor on the starting date of reservation.Have questions about the cancellation policy?
